Description of Services

American Canyon Heavy Duty Towing provides towing, vehicle recovery, roadside assistance, and related services in American Canyon, CA and surrounding North Bay communities. Our services include but are not limited to heavy duty towing, accident recovery, flatbed towing, commercial towing, emergency towing, winch-out service, and vehicle storage.

Service availability depends on the type of request, equipment availability, road conditions, and our service area coverage. We reserve the right to decline any service request at our discretion, including requests that fall outside our service area, require equipment we do not have available, or present safety risks to our operators.

Estimates and Pricing

Any estimate provided before service begins is an approximation based on the information available at the time. Final pricing may differ from an initial estimate if the actual scope of work, vehicle condition, road conditions, or other factors differ from what was described when the estimate was given.

We will inform you of any material change to the estimated price before proceeding with additional work when circumstances allow. For emergency situations where immediate action is required, we will provide pricing information as soon as it is practicable.

Towing rates in certain situations - particularly tows requested by law enforcement on California state highways - are subject to rate caps set by the California Highway Patrol or local jurisdictions. For privately arranged services, pricing is agreed upon between you and our company prior to service completion.

Scheduling and Cancellation

For non-emergency services scheduled in advance, please notify us as soon as possible if you need to cancel or reschedule. Cancellations made after a vehicle has been dispatched to your location may be subject to a trip charge to cover fuel and operator time.

For emergency and roadside assistance calls, we dispatch as quickly as available resources allow. Arrival times are estimates based on current conditions and are not guaranteed. We are not liable for delays caused by traffic, weather, road closures, or other circumstances outside our control.

If you cancel after our operator has arrived on scene and begun setup, you may be charged for the response, setup time, and any work already performed.

Payment Terms

Payment for services is due at the time of service completion unless a prior billing arrangement has been made. We accept cash and major credit cards. For commercial accounts and fleet operators, alternate payment arrangements may be available upon request.

If your insurance carrier is covering the cost of a tow or recovery, it is your responsibility to confirm coverage before service begins and to provide necessary claim or authorization information to our dispatcher. We may bill your insurer directly where that arrangement exists, but final responsibility for payment remains with you if the insurer does not pay.

Storage fees for vehicles held at our facility begin accruing on a daily basis from the time the vehicle arrives. You will be notified of applicable storage rates. Vehicles not claimed within the period required by California law may be subject to lien sale procedures in accordance with California Vehicle Code requirements.

Your Responsibilities

You agree to:

• Provide accurate information about the location, vehicle type, vehicle condition, and nature of the service needed
• Disclose any known hazards at the service location, including fluids, unstable ground, or traffic conditions
• Not misrepresent the weight, size, or condition of the vehicle to be towed
• Ensure you have the legal authority to authorize towing or service on the vehicle in question
• Remove personal property from the vehicle before or promptly after towing, as we are not responsible for personal items left in a towed vehicle

Limitation of Liability

To the fullest extent permitted by applicable law, American Canyon Heavy Duty Towing shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to our services or your use of our website, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from a specific service shall not exceed the amount you paid us for that service.

We are not liable for pre-existing damage to a vehicle, damage caused by the condition of the vehicle itself (such as a compromised frame or structural failure during towing), or loss of personal property left in a towed vehicle. Our operators document vehicle condition at the time of pickup, and that documentation is the reference point for any damage claim.

Warranty Disclaimers

Our website and the information on it are provided "as is" without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components. Service descriptions on our website are for informational purposes and do not constitute a guarantee of availability or outcome for any specific situation.

Dispute Resolution

If a dispute cannot be resolved informally, both parties agree to submit the matter to binding arbitration under the rules of a recognized arbitration service, rather than pursuing litigation in court, except where prohibited by law. Nothing in this clause prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.

Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceeding arising from or related to these terms shall be brought in a court of competent jurisdiction in California.
